Acceptance of Terms

By accessing or using OCUPA Tracker (the "Service"), available at ocupatracker.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.

These Terms apply to all users of the Service, including:

Session Owners — players or team captains who create and manage a specific match session
Scorekeepers and Editors who access sessions via a shared QR code or link
Viewers who access sessions in a read-only capacity via a shared link or QR code

By accessing the Service in any of the above roles, you acknowledge that you have read, understood, and agree to be bound by these Terms. Session Owners who create a session provide affirmative acceptance of these Terms at the time of session creation. Scorekeepers, Editors, and Viewers accept these Terms by accessing a session link or scanning a session QR code.

About the Service

OCUPA Tracker is an independent Progressive Web Application (PWA) designed to assist pool league players in managing match sessions, recording scores, generating scorecards, and sharing session access during live league play. The Service is developed and operated by Ryan Cheng, an individual doing business as OCUPA Tracker ("Platform Operator," "we," "us," or "our").

Important distinction: The term "Platform Operator" refers exclusively to Ryan Cheng as the developer and operator of the OCUPA Tracker platform. Within an active session, the term "Owner" refers to a pool player — typically a team captain or designated player — who has been granted session control access for the purpose of managing a single match. These are separate roles. Players who access the Service in any capacity are users of the platform and are not affiliated with its operation or development.

OCUPA Tracker is an independent tool and is not affiliated with, endorsed by, or operated by the United States Professional Poolplayers Association (UPA) or any other billiard league organization. Any league rules, formats, or scoring conventions implemented within the Service are used solely for operational convenience and do not constitute an affiliation, partnership, or licensing relationship with any such organization.

Intellectual Property and Ownership

3.1 Service Ownership

The Service, including its source code, architecture, design, user interface, features, functionality, and all content generated by Ryan Cheng in connection with the Service, is the exclusive intellectual property of Ryan Cheng. All rights are reserved. The Service is protected by United States copyright law and international intellectual property treaties.

3.2 Prohibited Uses of Service Content

You may not, without the express written permission of the Platform Platform Operator:

Copy, reproduce, modify, or create derivative works based on the Service or any portion thereof
Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
Sell, sublicense, transfer, or otherwise exploit the Service or access to it for commercial purposes
Remove, alter, or obscure any copyright, trademark, or proprietary notice within the Service
Use automated means — including bots, scrapers, or crawlers — to access, collect, or copy data from the Service

3.3 Session Data

Session data entered into the Service — including match scores, player information, and scorecard outputs — is generated by users. You retain responsibility for the accuracy of data you enter. The Platform Platform Operator does not claim ownership over user-generated session data but reserves the right to store, process, and transmit it as necessary to operate the Service.

3.4 User License

Subject to these Terms, the Platform Operator grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purpose: managing and recording pool league match sessions within authorized league operations.

Access Roles and User Responsibilities

4.1 Session Owner (Team Captain or Designated Player)

The Session Owner is a pool player — typically a team captain or a player designated by their team — who has been granted session control access for the duration of a single match. The Owner role is a session-level access level and does not imply any administrative, operational, or ownership relationship with the OCUPA Tracker platform itself. By accessing the Service as a Session Owner, you agree that:

You will use session control access solely for the purpose of managing the specific match for which access was granted
You will not use Owner-level access to alter, manipulate, or interfere with scoring data in a manner inconsistent with the actual outcome of play
You will distribute Scorekeeper and Viewer access — including QR codes and session links — only to individuals participating in or observing the match
You will not attempt to access, modify, or disrupt sessions other than the one for which you were granted access
You understand that session control access is temporary and tied to a specific match session only

4.2 Scorekeeper / Editor

Scorekeepers and Editors access the Service via a session-specific QR code or shared link. By accessing a session in this role, you agree that:

You will only enter accurate match data as it occurs during live play
You will not manipulate, falsify, or alter scoring data for any reason
You will not share your session access link or QR code with unauthorized parties
Your access is limited to the specific session for which you were granted access

4.3 Viewer

Viewers access the Service in a read-only capacity via a session-specific QR code or link. By accessing a session as a Viewer, you agree that:

You will not attempt to access functions or data beyond your designated read-only permissions
You will not record, screenshot, or reproduce session data for purposes that could harm the integrity of league operations
You will not share your Viewer access link with parties who are not authorized to view the session

Prohibited Conduct

In addition to the role-specific responsibilities above, all users of the Service agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
Attempt to gain unauthorized access to any portion of the Service, its servers, or any systems connected to the Service
Interfere with or disrupt the integrity or performance of the Service
Transmit any harmful, offensive, or disruptive code or content through the Service
Use the Service in any manner that could damage, disable, or impair the Service or its availability to other users
Attempt to probe, scan, or test the vulnerability of the Service or circumvent any security measures
Misrepresent your identity or role when accessing the Service

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PLATFORM OPERATOR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY DATA OR CONTENT

The Platform Operator does not warrant that any errors or defects in the Service will be corrected, or that the Service or the servers that make it available are free of viruses or other harmful components. Your use of the Service is entirely at your own risk.

The Service is not responsible for any disputes arising from scoring inaccuracies, league rule interpretations, or data entry errors made by users. League operations and any official rulings remain the sole responsibility of the relevant league organization and its designated officials.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RYAN CHENG, THE PLATFORM OPERATOR OF OCUPA TRACKER, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of data or session records
Loss of revenue, prize funds, or league fees
Disputes arising between players, teams, captains, or league operators resulting from Service use, scoring decisions, or data entry
Match outcome disputes, score inaccuracies, or disagreements over session records
Misuse of session access by any player granted Owner, Scorekeeper, Editor, or Viewer access
Service downtime, connectivity issues, or data loss during live league sessions
Any decisions made by league operators, team captains, or players based on data displayed within the Service
Any other damages arising out of or in connection with your use of, or inability to use, the Service

The Platform Operator is not a party to any match, league session, or dispute between players or teams. OCUPA Tracker is a neutral scoring and session management tool. All league operations, official rulings, and dispute resolutions remain the sole responsibility of the relevant league organization and its designated officials — not the players, team captains, or any user of this Service.

This limitation applies regardless of the theory of liability — whether in contract, tort, negligence, strict liability, or otherwise — and even if the Platform Operator has been advised of the possibility of such damages.

In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not permitted, the Platform Platform Operator's liability shall be limited to the maximum extent permitted by law.

Privacy

OCUPA Tracker is designed to operate without collecting personally identifiable information from users. The Service does not require user registration, does not collect names, email addresses, or payment information, and does not use tracking cookies or advertising technologies.

Session data entered into the Service — including match scores and scorecard outputs — is stored solely for the purpose of supporting active league sessions and is not sold, shared, or disclosed to third parties.

If you believe any data associated with your use of the Service should be removed, please contact the Platform Operator at the address listed in Section 11.

Modifications to the Service and Terms

9.1 Service Modifications

The Platform Operator reserves the right to modify, suspend, or discontinue the Service — or any feature or portion thereof — at any time and without prior notice. The Platform Operator shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

9.2 Terms Modifications

The Platform Operator reserves the right to update or modify these Terms at any time. When changes are made, the Effective Date at the top of this document will be updated. Continued use of the Service following any modification constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

Termination of Access

The Platform Operator reserves the right to terminate or suspend your access to the Service, at the Platform Operator's sole discretion and without prior notice, if you violate any provision of these Terms or engage in conduct the Platform Operator reasonably determines to be harmful to the Service, its users, or the integrity of league operations.

Upon termination, all rights granted to you under these Terms will immediately cease. Provisions of these Terms that by their nature should survive termination — including intellectual property, disclaimer of warranties, limitation of liability, and governing law — shall survive.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, California.

You waive any objection to the laying of venue of any such proceeding in Orange County, California, and waive any objection that such courts are an inconvenient forum.
